Travel service agreement and declaration of liability

This agreement applies between Freedom Ha Giang Loop ("Freedom", "we", "Party A") and you, the customer ("you", "Party B"), whenever you book or take part in one of our Ha Giang Loop motorbike tours. It is made on the basis of the Civil Code of Vietnam (Law No. 91/2015/QH13 of 24 November 2015), the Law on Tourism currently in force, and the capabilities and needs of both parties.

Whereas: Freedom is a company organising motorbike tours on the Ha Giang Loop, operating under Vietnamese law and the business registration and travel-service licences held by the company named in the footer of this website. You are a traveller who wants to take part in one or more tours organised by Freedom.

The two parties agree to the following declaration of liability, which covers your participation in any tour provided by Freedom.

Article 1. Purpose

a. This declaration sets out clearly what each party is responsible for while you take part in a tour provided by Freedom.

b. By booking, paying a deposit or the full price, and/or using any service supplied by Freedom or its partners as part of the tour you chose, you confirm that you have read, understood and fully agree to these terms.

Article 2. Your commitments

a. You follow the instructions and rules of the tour guide, the tour manager and Freedom's staff from preparation to the end of the tour. This includes the rules on personal safety (a helmet on your head every time the bike moves), environmental protection, fire safety, the laws of Vietnam, the protection of landscapes and heritage, and the rules of each place we visit, including homestays, villages and border areas.

b. You accept that Freedom may alter or change the itinerary of the tour you chose in order to keep you safe. In that case you follow Freedom's instructions and do not claim compensation from Freedom.

c. If your health or physical condition means you cannot complete a stage of the trip, Freedom decides whether the trip ends for you. If the trip ends early for personal reasons or because of your health or physical condition, you bear all costs that follow (accommodation, transport, flights and similar).

d. You are responsible for your own equipment and belongings, and for everything Freedom lends you: helmet, protective gear, rain coat and, if you ride by yourself, the motorbike with its key and papers. Damage you cause beyond normal wear is your responsibility.

e. You understand and acknowledge that travel always carries risks to your health, life and property, and that travelling by motorbike on mountain roads carries more than most. These risks include, without being limited to: falls and collisions, road hazards and loose surfaces, sudden changes in mountain weather, mechanical failure, insects and animals, accidents while travelling, limited medical facilities far from Ha Giang City, personal injury and death. You confirm that you are physically and mentally fit to take part, that you have told us about any health condition that could matter, and that you voluntarily assume full responsibility for all risks that arise, direct or indirect, throughout the trip, except where there is clear evidence of direct and serious fault on the part of Freedom, or where liability cannot be excluded under Vietnamese law.

f. If you book the ride-by-yourself option, you confirm that you hold a valid national driving licence and an International Driving Permit (1968 convention, category A/A1), that you are competent to ride a motorbike on mountain roads, and that any traffic fine or police matter arising from your riding is yours to settle.

g. You do not ride, as driver or passenger, under the influence of alcohol or drugs. A guide who judges that you are unfit to ride may end your participation without refund.

Article 3. Cases where Freedom is not liable

Freedom is not liable in the following cases:

a. Your personal information. Freedom is not responsible for the accuracy of the information you give us; for a leak of your personal information caused by a security problem on your own device (viruses, malware and the like) or by deliberate access by a third party; or for problems on your side while accessing the website, making a payment, or following a link to an external website.

b. Force majeure. Freedom does not pay compensation when a trip is delayed, changed or cancelled because of events beyond its control, such as natural disasters, landslides, road closures ordered by the authorities, epidemics, strikes, war, changes in immigration policy, technical failures of transport and similar events. The options we offer in these cases are set out in our Refund, Cancellation & Postponement Policy.

c. Third-party services. Freedom is not responsible for the quality of services supplied by third parties, including the bus companies that operate the pick-up from Hanoi, Sapa, Ninh Binh, Cat Ba and Ha Long, homestays, restaurants, airlines and other carriers. This covers, without being limited to, cancellations, delays, lost luggage and unsatisfactory service. We help you contact the party concerned, but any compensation follows that party's own terms or your insurance.

d. Your own actions. Freedom is not responsible for consequences caused by your own conduct, such as breaking the law, using stimulants, causing disorder, or failing to follow the general rules and the guide's instructions.

e. Undeclared health conditions and known risks. Freedom is not liable if you suffer a health problem before or during the trip that you did not declare in advance (including pregnancy and underlying medical conditions), or if harm arises from adventurous activities whose risks Freedom told you about beforehand, unless the harm is caused by Freedom's direct fault.

f. Personal property. Freedom is not liable for the loss, misplacement or damage of personal property, money, belongings or identity documents during your participation in the trip. This includes luggage left in our free storage while you ride: keep your passport, cash and valuables on you.

g. Traffic offences. If you ride by yourself, Freedom is not responsible for fines, confiscations or other consequences of riding without the required licence and permit, without a helmet, or in breach of Vietnamese traffic law.

Article 4. General terms

a. This declaration takes effect the moment you complete a booking and confirm the service through our online system or in writing, including by paying a deposit or the full price, or by written confirmation on WhatsApp or email.

b. Freedom and you agree to carry out every term of this declaration in good faith and with full responsibility.

c. This declaration is legally valid without a handwritten signature. Your booking record, our written confirmation on WhatsApp or email and the payment transaction are the official evidence of the agreement between us.

d. Both parties may store this declaration electronically, and the electronic copy has the same legal value as a signed paper copy.

e. This declaration is governed by the law of Vietnam. Any dispute is first settled by discussion and mutual agreement; if that fails, it is finally resolved by the Vietnam International Arbitration Centre (VIAC). Claims must reach us in writing within 30 days of the end of your tour, as set out in our Refund, Cancellation & Postponement Policy.

f. This declaration should be read together with our Payment Policy and Refund, Cancellation & Postponement Policy.

Confirmation

By completing a booking with Freedom, you confirm that you have read, understood and accepted every term above, including the acknowledgement of risk in Article 2.
